Terms of Service
These Terms of Service ("Terms") govern your access to and use of the MinuteMayhem mobile applications, websites, and related services (the "Service"), operated by Minute Mayhem LLC ("MinuteMayhem," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service you represent that you meet these requirements. The Service is intended for use by adults; children may not create accounts or use the Service directly.
2. The marketplace
MinuteMayhem is a marketplace that connects Parents and guardians ("Parents") with independent babysitters ("Sitters"). Sitters are independent contractors and are not employees, agents, or representatives of MinuteMayhem. We do not employ, supervise, direct, or control Sitters, and we do not provide childcare ourselves. Parents and Sitters are solely responsible for their interactions, arrangements, and the care provided. MinuteMayhem provides the technology platform that facilitates introductions, bookings, messaging, and payments.
3. Accounts and responsibilities
You are responsible for the accuracy of the information you provide, for keeping your login credentials confidential, and for all activity under your account. You agree to provide truthful information, keep it up to date, and notify us promptly of any unauthorized use of your account. We may suspend or terminate accounts that violate these Terms or that we reasonably believe present a safety or fraud risk.
4. Bookings and payments
When a Parent books a Sitter, the Parent agrees to pay the Sitter's hourly rate plus a MinuteMayhem service fee of 15% of the booking subtotal. The full total is shown before the booking is confirmed. Payments are processed by our payment processor, Stripe; by booking, you also agree to any applicable Stripe terms. Sitter rates are set by Sitters and vary. See our Pricing page for details. Sitters receive payouts through Stripe Connect, less the service fee, subject to processing and payout schedules.
5. Cancellations and refunds
Cancellations and refunds are governed by our Cancellation & Refund Policy, which is incorporated into these Terms. Cancellation fees may apply depending on how close to the booking start time a cancellation occurs.
6. Background checks
Sitters are required to complete a background check through our verification partner, Checkr, before they may accept bookings. Background checks have inherent limitations and rely on third-party data sources. A background check is not a guarantee of any person's suitability, conduct, or safety. Parents are responsible for exercising their own judgment, meeting Sitters, and making their own decisions about who cares for their children. MinuteMayhem does not warrant the accuracy or completeness of any background check.
7. User conduct
You agree not to: violate any law; provide false information; harass, threaten, or harm others; circumvent the Service to avoid fees; misuse another user's information; attempt to access the Service without authorization; or use the Service for any purpose other than arranging lawful childcare. You are responsible for your interactions with other users.
8. Disclaimers
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, MinuteMayhem disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, and we make no warranty regarding the conduct, reliability, or suitability of any Parent or Sitter.
9. Limitation of liability
To the fullest extent permitted by law, MinuteMayhem and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service or any interaction with a Parent or Sitter. To the extent liability cannot be excluded, our total liability is limited to the greater of the amount you paid us in the twelve (12) months before the event giving rise to the claim, or one hundred U.S. dollars ($100).
10. Indemnification
You agree to indemnify and hold harmless MinuteMayhem and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your interactions with other users.
11. Dispute resolution and governing law
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in the State of Illinois, and you consent to their jurisdiction.
12. Changes to these Terms
We may modify these Terms from time to time. When we make material changes, we will update the effective date above and provide notice where appropriate. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
